In a significant hearing before the Supreme Court, a crucial question of law arose concerning the maintainability of an appeal challenging the reversal of an acquittal—specifically, whether such an appeal could be summarily dismissed or required full admission for hearing.
Senior Advocate Mr. Anand Sanjay M Nuli, appearing for the appellant, was called upon to clarify the legal position. Finding himself momentarily unsure, he sought the assistance of Senior Advocate Mr. Siddharth Luthra, who was present in the courtroom. Mr. Luthra requested time to conduct research on the issue and report back later in the day.
At that moment, Advocate Mr. Pawan Reley, an Advocate-on-Record in the Supreme Court who had just secured a favorable order in an earlier matter, rose to inform the Court that although he was not representing any party in the case at hand, he had already conducted research on the legal question being considered.
Taken aback by the young lawyer’s preparedness, the bench asked, “Oh, really? What is the answer?”
As Mr. Luthra approached the bench, the Court gestured toward Mr. Reley with a smile, saying, “I want to hear the young man. Please go ahead and explain your proposition.”
Mr. Reley then laid out a well-structured legal argument, drawing the Court’s attention to Order 21 Rule 15 of the Supreme Court Rules, 1966, and Order 20 Rule 5 of the Supreme Court Rules, 2013. He also cited relevant case law, including Sita Ram and Ors. vs State of Uttar Pradesh, (1979) 2 SCC 656, particularly focusing on Paragraph 50 and related portions.
After Mr. Reley contextualized his analysis within the facts of the case, the bench was visibly impressed. The Hon’ble Court acknowledged his clarity and depth of understanding, stating:
“We would like to appreciate the efforts and assistance given to us by this learned young man.”
Further, Senior Advocate Mr. Siddharth Luthra proposed that Mr. Reley’s valuable contribution be officially recognized. He suggested:
“My Lords, the appearance of this young man should be recorded on the top.”
Taking note of the suggestion, the Court dictated its order, recording the presence and assistance of Senior Advocates Mr. Siddharth Luthra and Mr. Anand Sanjay M Nuli, along with Advocate-on-Record Mr. Pawan Reley—marking a moment of deserved recognition for the young lawyer’s initiative and preparedness.
